1. Agreement to These Terms

These Terms of Use (the “Terms”) are a legally binding agreement between you and Triangle Therapist, LLC (“Triangle Therapist,” “Company,” “we,” “us,” or “our”), a North Carolina limited liability company, governing your access to and use of triangletherapist.com and all related pages, tools, content, features, applications, and services (collectively, the “Services”).

By accessing or using the Services, creating an account, checking an agreement box, submitting content, or clicking “I agree,” you acknowledge that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy, which is incorporated into these Terms by reference. If you do not agree, you must not access or use the Services.

If you use the Services on behalf of an organization or professional practice, you represent that you have authority to bind that organization, and “you” includes that organization.

2. Definitions

“User” means any person who accesses or uses the Services, including visitors, individuals seeking mental health providers, and Professional Members.

“Professional Member” means a licensed or associate-licensed professional who applies for, creates, or maintains a directory profile or account through the Services.

“Member Content” means any content submitted by a Professional Member, including profile text, biographies, photographs, articles, essays, book recommendations and notes, event listings, and any other materials.

“User Submissions” means any content or information submitted by any User, including consultation requests, form entries, quiz responses, emails, and feedback.

“Site Content” means all content made available through the Services other than Member Content and User Submissions, including text, design, graphics, illustrations, logos, quizzes, guides, interactive tools, page layouts, software, and compilations.

3. Nature of the Services; No Medical or Clinical Relationship

3.1 Directory and Educational Platform

Triangle Therapist operates a technology platform, professional directory, and educational resource. The Services are designed to help individuals locate independent licensed mental health professionals and to provide general educational content about therapy and mental health.

3.2 No Provision of Healthcare

Triangle Therapist does not provide psychotherapy, counseling, psychological services, medical services, diagnosis, or treatment through the Services. Nothing on the Services constitutes medical, psychological, clinical, legal, or professional advice. Educational content — including articles, guides, quizzes, book recommendations, and interactive tools — is provided for general informational purposes only and is not a substitute for professional judgment, diagnosis, or treatment by a qualified professional who knows your circumstances.

3.3 No Therapist-Client Relationship With Triangle Therapist

Use of the Services, including submitting a consultation request, taking a quiz, subscribing to communications, or communicating with Triangle Therapist, does not create a therapist-client, physician-patient, fiduciary, or clinical relationship between you and Triangle Therapist. Any therapeutic relationship exists solely between you and the independent professional you engage.

3.4 Emergencies

The Services are not intended for emergencies and are not monitored in real time. If you are experiencing a mental health crisis, thoughts of harming yourself or others, or any emergency, do not use the Services — call or text 988 (Suicide & Crisis Lifeline) or call 911 immediately.

3.5 Quizzes and Interactive Tools

Quizzes and interactive tools (such as the attachment style quiz and educational guides) are self-reflection and educational exercises. They are not diagnostic instruments, do not constitute assessments, and must not be relied upon to make health decisions.

4. Independent Professionals; No Endorsement or Guarantee

4.1 Independent Status

Every professional listed through the Services is an independent provider. Professional Members are not employees, agents, partners, joint venturers, or representatives of Triangle Therapist. Triangle Therapist does not supervise, direct, or control any professional’s clinical work, treatment decisions, scheduling, fees, insurance participation, communications, or records.

4.2 Verification Is Not Endorsement

Triangle Therapist verifies that Professional Members hold an active license (or associate license under supervision) in the U.S. state they identify at signup before publishing a profile. Verification is a point-in-time check of licensure status only. It is not, and shall not be construed as, an endorsement, recommendation, certification of competence, guarantee of quality, prediction of outcomes, or ongoing monitoring of any professional. License status can change; Users are responsible for independently confirming a professional’s current credentials, fit, and suitability.

4.3 User Responsibility for Selection

You are solely responsible for evaluating and selecting any professional, for the decision to begin, continue, or end services with any professional, and for all interactions, agreements, appointments, payments, and outcomes between you and any professional. Matching tools on the Services are convenience filters based on information provided by Professional Members and do not constitute clinical triage or referral.

5. Eligibility

The Services are intended for adults. You must be at least 18 years old to create an account, submit a consultation request, or subscribe to communications. Individuals under 18 may view educational content only with the involvement of a parent or guardian. Parents or guardians seeking care for a minor should submit inquiries themselves. By using the Services you represent that you meet these requirements and that any information you provide is accurate.

6. Accounts and Security

6.1 Account Registration

Certain features require an account. You agree to provide accurate, current, and complete information and to keep it updated. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us promptly at connect@triangletherapist.com of any unauthorized use.

6.2 Our Discretion

Triangle Therapist may refuse, suspend, limit, or terminate any account or application at its sole discretion, with or without notice, including for suspected fraud, misrepresentation, license issues, violation of these Terms, or conduct we reasonably believe harms Users, professionals, or the Services.

7. Professional Member Terms

This Section applies to Professional Members in addition to all other provisions of these Terms.

7.1 Application and License Verification

By applying to join the directory, you represent and warrant that you hold an active license, or associate license under appropriate supervision, issued by the licensing authority of the U.S. state you identify at signup; that all information you provide — including your name, credential, and license number — is truthful and accurate; and you authorize Triangle Therapist to verify your license number and standing with the applicable licensing board and public professional databases, at application and periodically thereafter.

7.2 Ongoing Obligations

You agree to: (a) maintain your license in good standing and comply with all applicable laws, licensing board rules, and professional ethical obligations; (b) promptly update your profile if your license status, supervision status, availability, credentials, or contact information changes; (c) notify Triangle Therapist promptly at connect@triangletherapist.com of any license suspension, revocation, surrender, or disciplinary action; and (d) accurately represent your services, formats, fees, and availability.

7.3 Supervision Listings

If you elect to be listed as offering clinical supervision, you represent that you meet all board requirements to provide supervision for the credential(s) under which you are listed. Supervision arrangements are made solely between supervisors and supervisees; Triangle Therapist is not a party to them.

7.4 Your Relationship With Clients

All client relationships, communications, records, confidentiality obligations, informed consent, fees, and clinical responsibilities are exclusively yours. You are solely responsible for your own HIPAA and confidentiality compliance, professional liability insurance, and adherence to your board’s requirements.

7.5 No Employment or Agency

Nothing in these Terms creates an employment, agency, partnership, joint venture, franchise, or referral-fee relationship between you and Triangle Therapist. You may not represent otherwise.

7.6 Publication Discretion

Triangle Therapist retains sole discretion over whether, when, where, and how profiles and Member Content are displayed, ranked, ordered, featured, or removed within the Services.

8. Member Content: License, Editorial Rights, and Article Permanence

8.1 License Grant

By submitting Member Content, you grant Triangle Therapist a non-exclusive, royalty-free, worldwide, sublicensable license to host, store, display, reproduce, distribute, format, adapt, edit, excerpt, translate, and create derivative works from that content, in any media now known or later developed, in connection with operating, improving, and promoting the Services (including social media and marketing uses).

8.2 Editorial Rights

Triangle Therapist may, at its discretion and without prior approval: edit articles and profile text for clarity, length, style, accuracy, formatting, and search visibility; adjust, crop, retouch, or replace photograph backgrounds for visual consistency; reformat book, event, and profile content to fit the Services’ design and functionality; and reformat outbound links (including applying the Company’s affiliate identifiers). We aim to preserve the substance and professional voice of your work, and content remains attributed to you unless disconnected under Section 8.3.

8.3 Articles Are Permanent; the Profile Connection Is Yours

Articles published on the Services become part of the Services’ permanent library and will not be deleted, including after you leave the directory or your account is terminated. You control the connection between any article and your profile: you may disconnect an article at any time through your profile editor, which removes it from your profile and removes your byline and author card from the article. Disconnected articles remain published under the Triangle Therapist byline. This Section survives termination.

8.4 Your Representations

You represent and warrant that you own or have all necessary rights to submit your Member Content; that it does not infringe or misappropriate any third party’s intellectual property, privacy, publicity, or other rights; that it contains no confidential client information or protected health information of any client; that it complies with your professional and ethical obligations, including advertising rules of your licensing board; and that it is accurate and not misleading.

8.5 Prohibited Member Content

Member Content must not include: client-identifying information or case details without lawful authorization; testimonials or claims prohibited by your licensing board; guarantees of treatment outcomes; false or unverifiable credentials; content generated to manipulate search rankings deceptively; or any content that violates Section 10 (Acceptable Use).

9. User Submissions and Feedback

9.1 Consultation Requests

Consultation requests are transmitted to the professional you select and to the Company’s practice inbox as described in the Privacy Policy. You agree not to include emergencies, detailed medical histories, or highly sensitive information in such requests. Triangle Therapist does not guarantee any response, response time, availability, or acceptance by any professional.

9.2 License to User Submissions

You grant Triangle Therapist a non-exclusive, royalty-free, worldwide license to use User Submissions as needed to operate the Services, respond to you, and improve the Services. If you provide ideas, suggestions, or feedback, we may use them without restriction or compensation.

10. Acceptable Use

You agree not to, and not to assist others to:

  • Use the Services for any unlawful purpose or in violation of any applicable law or regulation;
  • Misrepresent your identity, credentials, licensure, or affiliation;
  • Submit false, deceptive, defamatory, harassing, hateful, obscene, or infringing content;
  • Contact professionals for solicitation, marketing, recruiting, or any purpose other than genuinely seeking or coordinating services;
  • Scrape, harvest, crawl, index, copy, or systematically extract data, profiles, contact information, or content from the Services, whether manually or by automated means (including bots, scripts, and AI training pipelines), without our prior written consent;
  • Circumvent, disable, or interfere with security features, rate limits, access controls, or verification processes;
  • Introduce viruses, malware, or harmful code; probe, scan, or test the vulnerability of any system; or interfere with the integrity or performance of the Services;
  • Impersonate any person or entity, or misstate your affiliation with any person or entity;
  • Use the Services to compete with Triangle Therapist, including building a competing directory from Services data;
  • Frame, mirror, or embed the Services without written permission;
  • Resell, sublicense, or commercially exploit the Services except as expressly permitted for Professional Members’ own profiles.

11. Events

Professional Members may list talks, trainings, CEU offerings, and community groups (“Events”). Events are organized, hosted, delivered, and controlled solely by the listing professional. Triangle Therapist does not organize, sponsor, endorse, supervise, or guarantee any Event, its content, its CEU eligibility, its safety, or its occurrence. Registration, payment, refunds, cancellations, and all Event terms are exclusively between attendees and the hosting professional through the professional’s own links and providers; Triangle Therapist collects no Event payments. Event listings may be marked cancelled or removed by the host or by Triangle Therapist at any time. Attendance at any Event is at your own risk.

12. Book Recommendations and Affiliate Disclosure

Book recommendations reflect the personal selections of individual Professional Members and are not clinical advice. Book links direct to third-party retailers. As an Amazon Associate, Triangle Therapist earns from qualifying purchases; links submitted by Professional Members may be reformatted to carry the Company’s affiliate identifier. Prices, availability, and fulfillment are controlled entirely by the retailer.

13. Intellectual Property

13.1 Site Content

The Services and all Site Content — including the Triangle Therapist name, logo, wordmark, the triangle-and-center mark, page designs, guides, quizzes, interactive tools, text, graphics, and the selection and arrangement of all content — are owned by Triangle Therapist, LLC or its licensors and are protected by copyright, trademark, trade dress, and other laws. Except for the limited right to view and use the Services for their intended purpose, no license or ownership rights are granted to you.

13.2 Limited Permission

You may view, download, and print pages for personal, non-commercial use, provided you keep all proprietary notices intact. Professional Members may share links to and screenshots of their own profiles and published articles for their own professional promotion.

13.3 Trademarks

“Triangle Therapist” and associated logos and marks may not be used in any manner likely to cause confusion, or to imply endorsement or affiliation, without prior written permission.

14. Copyright Complaints (DMCA)

If you believe content on the Services infringes your copyright, send a notice to connect@triangletherapist.com containing: (a) identification of the copyrighted work; (b) identification and location (URL) of the allegedly infringing material; (c) your name, address, telephone number, and email; (d) a statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent, or the law; (e) a statement, under penalty of perjury, that the information in your notice is accurate and that you are the owner or authorized to act for the owner; and (f) your physical or electronic signature. We may remove or disable access to allegedly infringing material and may terminate repeat infringers’ access.

15. Third-Party Websites and Services

The Services link to and integrate third-party websites and services, including professional websites, event registration and payment pages, retailers, map providers, and social platforms. Triangle Therapist does not control and is not responsible for third-party content, policies, products, services, or practices. Your use of third-party services is at your own risk and subject to their terms.

16. Fees and Changes to the Services

The directory is currently free for Users and Professional Members. Triangle Therapist reserves the right to introduce, modify, or discontinue features, and to introduce fees, subscriptions, or premium placements for Professional Members in the future, with reasonable advance notice for any fees applicable to existing Professional Members. We may modify, suspend, or discontinue any part of the Services at any time without liability.

17. Suspension and Termination

17.1 By You

You may stop using the Services at any time. Professional Members may request removal of their profile at any time by emailing connect@triangletherapist.com or through their account.

17.2 By Us

We may suspend or terminate your access, account, profile, or listings at any time, with or without cause or notice, including for violation of these Terms, license issues, legal risk, extended inactivity, or discontinuation of the Services.

17.3 Effect of Termination

Upon termination: your right to use the Services ceases; your profile may be unpublished; and published articles remain on the Services as provided in Section 8.3. Sections that by their nature should survive — including Sections 3, 4, 8, 9, 12, 13, 18, 19, 20, 21, and 22 — survive termination.

18. Disclaimers of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, OR UNINTERRUPTED OR ERROR-FREE OPERATION. WITHOUT LIMITING THE FOREGOING, TRIANGLE THERAPIST MAKES NO WARRANTY OR REPRESENTATION REGARDING: THE QUALIFICATIONS, COMPETENCE, CONDUCT, AVAILABILITY, OR PERFORMANCE OF ANY PROFESSIONAL; THE OUTCOME OF ANY THERAPEUTIC OR PROFESSIONAL RELATIONSHIP; THE ACCURACY OR COMPLETENESS OF ANY PROFILE, ARTICLE, EVENT, OR OTHER CONTENT; OR THE RESULTS OF ANY QUIZ, MATCHING TOOL, OR EDUCATIONAL RESOURCE. NO ADVICE OR INFORMATION OBTAINED FROM THE SERVICES CREATES ANY WARRANTY NOT EXPRESSLY STATED IN THESE TERMS.

19. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW: (A) IN NO EVENT WILL TRIANGLE THERAPIST, ITS MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, CONTRACTORS, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OPPORTUNITY, ARISING OUT OF OR RELATED TO THE SERVICES OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES; (B) TRIANGLE THERAPIST SHALL HAVE NO LIABILITY ARISING FROM OR RELATED TO THE ACTS, OMISSIONS, SERVICES, CONTENT, OR CONDUCT OF ANY PROFESSIONAL MEMBER, ANY EVENT, OR ANY THIRD PARTY; AND (C) TRIANGLE THERAPIST’S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS SHALL NOT EXCEED THE GREATER OF (i) ONE HUNDRED U.S. DOLLARS (US $100) OR (ii) THE AMOUNTS YOU PAID TO TRIANGLE THERAPIST FOR THE SERVICES IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN SUCH JURISDICTIONS, LIABILITY IS LIMITED TO THE FULLEST EXTENT PERMITTED BY LAW. THE LIMITATIONS IN THIS SECTION ARE FUNDAMENTAL ELEMENTS OF THE BARGAIN BETWEEN YOU AND TRIANGLE THERAPIST.

20. Indemnification

You agree to defend, indemnify, and hold harmless Triangle Therapist, LLC and its members, managers, officers, employees, contractors, and agents from and against any claims, demands, actions, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use or misuse of the Services; (b) your Member Content or User Submissions; (c) your violation of these Terms or of any law or third-party right; (d) for Professional Members, your professional services, client relationships, Events, supervision arrangements, licensure, or advertising; and (e) any dispute between you and any other User or professional. We reserve the right to assume the exclusive defense of any matter subject to indemnification, in which case you agree to cooperate.

21. Dispute Resolution; Governing Law; Arbitration; Class Waiver

21.1 Informal Resolution First

Before filing any claim, you agree to contact us at connect@triangletherapist.com with a written description of the dispute and give us thirty (30) days to attempt resolution.

21.2 Governing Law and Venue

These Terms and any dispute arising out of or relating to them or the Services are governed by the laws of the State of North Carolina, without regard to conflict-of-law principles. Subject to Section 21.3, exclusive venue for any permitted court proceeding lies in the state and federal courts located in Wake County, North Carolina, and you consent to personal jurisdiction there.

21.3 Binding Arbitration

Except for (a) small-claims matters within that court’s jurisdiction and (b) claims for injunctive relief regarding intellectual property or unauthorized access, any dispute arising out of or relating to these Terms or the Services shall be resolved by final, binding arbitration administered by the American Arbitration Association under its rules, conducted by a single arbitrator in Wake County, North Carolina (or remotely by agreement). Judgment on the award may be entered in any court of competent jurisdiction. YOU AND TRIANGLE THERAPIST EACH WAIVE THE RIGHT TO A TRIAL BY JURY.

21.4 Class Action Waiver

ALL DISPUTES SHALL BE BROUGHT IN AN INDIVIDUAL CAPACITY ONLY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate claims or preside over any form of representative proceeding.

21.5 Time Limit on Claims

To the extent permitted by law, any claim arising out of or relating to the Services or these Terms must be filed within one (1) year after the claim accrued, or it is permanently barred.

21.6 Opt-Out

You may opt out of Sections 21.3 and 21.4 by emailing connect@triangletherapist.com within thirty (30) days of first accepting these Terms, stating your name and intent to opt out of arbitration.

22. General Provisions

Modifications to Terms. We may update these Terms from time to time. The updated version will be posted with a revised date, and material changes may be communicated by notice on the Services or by email. Continued use after changes take effect constitutes acceptance.

Electronic Communications. You consent to receive communications from us electronically, and agree that electronic notices, agreements, and records satisfy any legal requirement of a writing.

Severability. If any provision is held invalid or unenforceable, it shall be enforced to the maximum extent permissible and the remaining provisions remain in full force.

No Waiver. Failure to enforce any provision is not a waiver of the right to enforce it later.

Assignment. You may not assign these Terms without our written consent. We may assign these Terms in connection with a merger, acquisition, reorganization, or sale of assets.

Force Majeure. Triangle Therapist is not liable for delays or failures caused by events beyond its reasonable control.

Entire Agreement. These Terms, together with the Privacy Policy and any additional posted policies or agreements (including any future Provider Agreement), constitute the entire agreement between you and Triangle Therapist regarding the Services and supersede all prior understandings.

Headings. Headings are for convenience only and have no legal effect.

Survival. Provisions that by their nature should survive termination shall survive, including licenses granted in Sections 8 and 9 and Sections 3, 4, 12, 13, 18, 19, 20, and 21.
